“TRANSITIONAL REGULATION LAW FOR ISOLATION, QUARANTINE, OBSERVATION AND SURVEILLANCE FOR COVID-19” and DECREE NUMBER 24.

On May 5, 2020, the Legislative Assembly approved Decree 639, which contains the “TRANSITIONAL REGULATION LAW FOR ISOLATION, QUARANTINE, OBSERVATION AND SURVEILLANCE FOR COVID-19” which aims to develop the conditions, time and manner of compliance with quarantine, surveillance or observation of people subject to said control measures, as determined by the Ministry of Health for COVID-19.

Article 8 of the aforementioned law regulates home quarantine throughout the territory of the Republic, pointing out the cases in which people, with justified causes, can circulate and in its literal d), it delimits the activities that people can carry out at the same time. leave their homes, these being the following:

  1. Those people whose need is the acquisition of food and beverages, pharmaceutical products, medical treatments, urgent assistance to pets and others who, due to an emergency, must go to a care center, markets or supermarkets to supply food and basic necessities.
  2. People whose purpose is the assistance and care of children, older adults, people with disabilities or especially vulnerable people, due to chronic illnesses who must travel to a place for emergency or periodic medical care, even if these people have to go to a center. hospital or clinic.
  3. The personnel who work in the media and press;
  4. Agricultural sector and independent workers in the same sector;
  5. Financial sector, AFP, INPEP and insurance.
  6. Private security services and maintenance technicians who provide basic services such as electricity, water, telephone and internet.

The Executive Body, through agreement in the Health Branch, as necessary, may establish additional justification grounds for circulation and will establish the procedures for its implementation.

On May 9, 2020, Executive Decree number 24 came into force, in the Health Branch, which develops the authorizations provided for in Art. 8 of the Regulation Law for Isolation, Quarantine, Observation and Surveillance for COVID-19 .

Said Decree repeals decrees numbers 22 and 23, ratifying some of the restrictions established in the repealed decrees and modifying other restrictions that were established, specifically on the free movement of people. The restrictions that remain are:

  1. The mobilization of the municipality from its residence to another municipality, except for:
  2. Go to your workplace; You must carry your mask, your company identification card and a letter from your employer, authorizing your mobility from your place of residence to the workplace, or
  3. In the event that there are no markets or supermarkets in the municipality of your residence, you can go to the nearest municipality only to buy food.
  4. Mobilization on specific days, according to the last number or the termination of your Unique Identity Document, Passport, Resident Card for foreigners, being enabled as follows:

Health workers, agents of the National Civil Police and elements of the Armed Forces will be able to enter supermarkets, pharmacies and banks regardless of the completion of their Unique Identity Document, unlike other people who must present it when entering. to these establishments.

Decree 24, in turn, modified the absolute prohibition of the circulation of public passenger transportation, enabling it only To mobilize duly identified health personnel, in addition, fishing was enabled as a commercial and industrial activity, permitted during the validity of this Decree.

The Decree establishes that the Government will provide free transportation to all those people with chronic diseases, cancer, kidney failure, diabetes, therapies and other similar diseases from their home to the hospital and vice versa.

It is important to mention that those people who do not have their Unique Identity Document, whether it is illegible or destroyed, may go to the National Registry of Natural Persons to have a certification of their DUI issued, with which they will be able to circulate and carry out the permitted procedures. by this Decree.

Decree 24 will be valid for 13 days from the day following its publication in the Official Gazette, so its effects will cease on May 22, 2020.
