Extension of the effects of the Law to install and maintain nurseries for employees' children.

ROMERO PINEDA & ASOCIADOS, informs you that the Legislative Assembly approved Decree No. 790, which was published in the Official Gazette No. 250, volume No. 429 dated December 16, 2020 through which it extends the entry into force of the “Special Law for the regulation and installation of nurseries for sons and daughters of workers”, for the January 1, 2022.

The Law was approved in 2018 and initially came into effect 24 months after its publication in the Official Gazette. The law contains 15 articles and regulates the right of employees to daycare centers and custody places for their sons and daughters, ranging in age from 4 months to 3 years, during the duration of their father or mother's work day.

According to the approved regulations, private sector employers will be obliged to comply with this benefit when they have 100 or more workers, having the power to define and implement the modalities through which they will comply with this law. Failure to comply carries fines between five to eight minimum wages.
