APPROVAL OF JOB STABILITY GUARANTEE FOR WOMEN AFTER MATERNITY LEAVE

ROMERO PINEDA & ASOCIADOS, informs you that on June 28, 2018, the Legislative Assembly during a plenary session approved reforms to the Labor Code with the purpose of guaranteeing job stability for working women beyond the stage of maternity leave.

The reform to Article 113 of the Labor Code expanded stability, establishing that from the moment the state of pregnancy begins, until they conclude six months after postnatal rest, de facto dismissal or dismissal with prior trial, will not result in the termination of the female worker's contract.

Failure by the employer to extend the guarantee of job stability will be punished with a fine of three to six current monthly minimum wages in the commerce and service sector. The foregoing, without prejudice to the rights recognized by labor legislation for pregnant workers.
