Asueto Nacional en El Salvador, en el mes de Diciembre y Enero

Estimados Clientes y Amigos:

ROMERO PINEDA & ASOCIADOS les recuerda que de conformidad al Artículo 190 del Código de Trabajo, se establecen como asuetos remunerados los días 25 de diciembre y 1º de enero de cada año, lo cual aplica tanto para las trabajadoras y trabajadores del sector público como del sector privado.

Los centros de trabajo que laboren los referidos días deberán pagar un salario extraordinario integrado por el salario ordinario más un recargo del 100% de éste. Asimismo, si trabajan horas extras o laboran en jornada nocturna, el cálculo para el pago de los recargos se hará en base al salario extraordinario antes mencionado.

Únicamente quedarán excluidos de los asuetos remunerados los trabajadores a domicilio y los trabajadores cuyos salarios se hayan estipulado por comisión o a destajo, por ajuste o precio alzado.

ROMERO PINEDA & ASOCIADOS reminds you that pursuant to Article 190 of the Labor Code, December 25th and the 1st of January of each year are established as paid holiday leave, applicable to the employees of the public and private sectors.

In this regard, employees working in the referred holiday must be paid an extraordinary wage composed of regular wage plus an extra charge of 100%. Also, if they work overtime or work a night shift, the calculation for the payment of extra charges will be based on the aforementioned extraordinary salary.

The holidays indicated are not applicable to home workers and workers whose wages have been stipulated by commission or by piecework, adjusted or fixed price.
