{"id":17019,"date":"2025-11-05T14:30:00","date_gmt":"2025-11-05T20:30:00","guid":{"rendered":"https:\/\/www.romeropineda.com\/?p=17019"},"modified":"2026-05-19T09:34:54","modified_gmt":"2026-05-19T15:34:54","slug":"genericidad-marcaria","status":"publish","type":"post","link":"https:\/\/www.romeropineda.com\/en\/genericidad-marcaria\/","title":{"rendered":"Brand Genericity"},"content":{"rendered":"<div data-elementor-type=\"wp-post\" data-elementor-id=\"17019\" class=\"elementor elementor-17019\" data-elementor-post-type=\"post\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-642e03d2 elementor-section-boxed elementor-section-height-default elementor-section-height-default qodef-elementor-content-no\" data-id=\"642e03d2\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-666ff15c\" data-id=\"666ff15c\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-46ab1be7 elementor-widget elementor-widget-text-editor\" data-id=\"46ab1be7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\n<p class=\"wp-block-paragraph\">By: Carlos Enrique Castillo Garc\u00eda, partner and director<\/p>\n\n\n\n\n\n<p class=\"wp-block-paragraph\">With the entry into force of the new Intellectual Property Law of El Salvador (February 17, 2025), the Salvadoran Institute of Intellectual Property (ISPI) was created, which, among other powers, was assigned the power to know and decide on the cancellation due to generalization (genericity) of previously registered trademarks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, Article 145 of the aforementioned Law establishes under the condition that, if the name of a brand, due to its widespread use in the market, becomes the generic name of one or more of the products or services for which it has been registered, the cancellation of the registration or inscription may be requested, or its scope may be limited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This provision clarifies that a trademark will be considered to have become a generic name for the product or service it covers when, in commercial circles and for the public, said trademark has lost its distinctive character as an indication of the business origin of the product or service to which it applies. That is, the trademark\u2014a word mark\u2014as a distinctive sign, is used in the local commercial or market as the name that identifies the category to which it has been applied. In this way, said trademark becomes the name used in usual or common commercial transactions to distinguish the product or service it has identified; thus losing its exclusive identity, or its distinctive character, and consequently, losing its legal protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any interested party may request the cancellation of a trademark, and the Institute (ISPI), through its superior authority, will declare the cancellation by means of a reasoned resolution. For this purpose, the following conditions must be met with respect to the trademark: a) The absence of another suitable name to designate the product or service to which the trademark applies in commerce. b) The widespread use of the trademark as a common or generic name for the respective product or service by the public and in commercial media.
