ROMERO PINEDA & ASOCIADOS informs you that the Legislative Assembly at its plenary session approved reforms to guarantee labor stability for workers with chronic disabling illnesses.
The reforms made to articles 30, 17º) and 110, as well as the inclusion of articles 308 – A and 308 – B of the Labor Code applicable to the private sector, grant labor stability to employees with chronic disabling diseases, such as cancer and chronic kidney disease, which require frequent medical checks and the respective rehabilitation process, or those that require a specialized technical and medical attention, with the prior validation of the primary care doctor, favorable working conditions for the employee suffering these illnesses will be guaranteed. .
The guarantee includes the right to keep working under the same conditions, the prohibition of not being assigned to activities that require physical efforts incompatible with the health condition or illness, or to be dismissed, and that the obligation to pay a subsidy is responsibility of the Salvadoran Social Security Institute (ISSS).
Said guarantee of work stability will start from the moment the primary care doctor has issued the corresponding diagnosis and will be extended until three months after the respective treatment has concluded.
The reforms will be in force once approved by the President of the Republic and published in the Official Gazette.
