ROMERO PINEDA & ASOCIADOS informs you that on June 28, 2018 the Legislative Assembly at its plenary session approved reforms to the Labor Code to guarantee labor stability for female employees beyond the maternity leave.
The reform of Article 113 of the Labor Code extended the labor stability, establishing that from the beginning of the pregnancy, until six months after maternity leave, the dismissal will not produce the termination of the employment contract of the working woman.
Employers who fail to guarantee said labor stability will be fined with three to six minimum monthly salaries in force in the commerce and service sectors. The foregoing without prejudice to the rights of the employee, according to what is stated in the labor legislation.
