Alternative Dispute Resolution (ADR):
Our goal is to obtain effective results for our clients, intervening in negotiations, mediation and arbitration procedures in representation of our client’s interests, preparation of complaints and annulment verdicts against unfavorable decisions.
Administrative Proceedings:
As a complement to our Trademark Department, we handle administrative proceedings before the Registry of Intellectual Property, such as trademark oppositions and remedies against the dismissal of trademarks, revision remedies, reverting petition remedies and appeals.
Pretrial Actions:
Pretrial actions before Customs Authorities are attempted in unfair competition actions and Intellectual Property related actions, by requesting close of borders measures and their execution.
Judicial Actions and Trials:
We are aware of the fact that not all disputes can be settled through ADR, and our litigation team is ready to execute legal actions and trials representing our domestic and international clients.
Civil and Commercial Actions:
These type of actions include case study and investigation, preparation of complaints, evidence and appeals, related to distribution, agency and franchise agreements, contractual disputes, unfair competition, partnership disputes, shareholders dispute, among others.
Intellectual Property Related Litigation:
Through the years RP&A has lead the field in Intellectual Property Enforcement, through judicial trademark cancellation trials, unfair competition related to trademarks and patent infringement trials.
Appeals:
Our trial practice includes the filing of appeals before the pertinent Chambers and before the Supreme Court of Justice.
Contentious Administrative Trials:
Are filed against resolutions issued by any government authority, once all the remedies provided by law are executed, a complaint may be filed before the Supreme Court of Justice. Our intervention in the trial involves the preparation of the complaint and further prosecution of the trial.
Intellectual Property Related Criminal Actions:
Our services include the prior investigation and preparation of complaints before the General Attorney Office, and further prosecution of the trial before the Criminal Courts, against unfair competition, counterfeiting and infringement.
Constitutional Law Issues:
Constitutional Law issues include the issuance of opinions and counsel, preparation of complaints and trial prosecutions, before the Constitutional Chamber of the Supreme Court of Justice.
Internet and Domain Name Disputes:
As a complement of the domain name registration practice of our Firm, the Litigation Department intervenes in mediation procedures related to domain name violations.
Consumer Protection Actions:
Representation of our clients before the Consumer Protection Bureau, includes intervention in the compulsory mediation procedure as well as in the administrative sanction setting procedure.
Advertisement Law actions:
Actions before the National Advertising Council are attempted to cease or prevent the use of misleading advertisement. Our services include the preparation of complaints and representation of our clients in the procedure.
Environmental Compliance & Regulatory Disputes:
These types of disputes involve several government agencies, such as the Ministry of Health and the Environment Ministry, our involvement includes representation before government agencies, complaint preparation and prosecutions of trials.
Labor Disputes:
Representation of our clients before administrative authorities in the compulsory mediation procedure and the judicial trials before the Labor Courts.
